Strange – benefits provided to employees are taxable to employees not the company? If a company provides use of an apartment to an employee then that use could be taxable to the employee but not the employer. This sounds pretty weak. At worst for trump it could be a small payroll tax issues. The people who got the benefit are all highly compsated so they would exceed the fica threshold but not the Medicare tax. Let’s say these benefits amounted to $1,000,000 in compensation that didn’t have the employer medicare withholdings it at most would be $20k in tax per year which is not much. No one will go to jail over that. I’m assuming they filed payroll tax returns so the statue would give the 3 years of assessments- at most $60 k in additional taxes due from the trump organization. A tiny adjustment that would not rise to the level of jail time.
